Terms of Service

1. Acceptance of Terms

By accessing or using Da Cycl ("the App", "the Service", "we", "us", or "our"), operated by Cycl Factory, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users of Da Cycl, including the web application at dacycl.com and the mobile applications on Android and iOS.

2. Description of Service

Da Cycl is a discipline tracking and educational tool designed to help users build consistent dollar-cost averaging (DCA) routines for cryptocurrencies and, in future releases, US-listed stocks including but not limited to NVDA, AAPL, MSFT, AMZN, GOOGL, META, TSLA, JPM, V, WMT, JNJ, XOM, MA, UNH, COST, HD, PG, BRK.B, ORCL, and AMD. Da Cycl provides: - DCA plan creation and event scheduling - Discipline score and streak tracking - Market cycle charts and historical price data - MA90 dynamic DCA signals (educational context only) - ATH-based projection simulations (educational context only) - Crypto and financial news aggregation - Cycl Points tracking (off-chain, non-monetary) - Push notifications for scheduled buy reminders Da Cycl does NOT provide: - Financial advice of any kind - Investment recommendations - Trade execution or brokerage services - Wallet custody or asset management - Guaranteed returns or profit projections

3. Not Financial Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING IN DA CYCL CONSTITUTES FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE. All projections, simulations, MA90 signals, ATH references, and market data displayed within the Service are for educational context only. Past prices do not predict future results. All-time high prices may never repeat. Users are solely responsible for their own investment decisions. Da Cycl is not a registered investment adviser, broker-dealer, or financial institution. The founders, operators, and team members of Cycl Factory are not licensed financial advisors. Do not make investment decisions based solely on information from Da Cycl. Always consult a qualified financial professional before making investment decisions.

4. No Trade Execution

Da Cycl does not execute, facilitate, or process any financial transactions, trades, or asset transfers on behalf of users. The "Done" and "Skip" actions within the App are self-reported tracking actions only. They do not trigger any real-world transactions. Users are responsible for executing their own trades through their chosen exchanges or brokerages.

5. Cycl Points and RECYCL Token

Cycl Points are off-chain reward points earned through disciplined use of Da Cycl. They have no monetary value and are not a financial instrument, security, or currency. The future RECYCL token has not yet launched (TGE date TBA). No guarantees are made regarding the RECYCL token, its value, its launch, or its exchangeability. Cycl Points may or may not be redeemable for RECYCL tokens at a future date. Nothing in the App constitutes a promise or commitment regarding the RECYCL token. Cycl Points and RECYCL are not offered as investments. They are utility mechanisms designed to reward disciplined use of the platform.

6. Stock DCA Features (Coming Soon)

Da Cycl plans to add DCA tracking for US-listed stocks including the top 20 most popular stocks by market capitalisation. These features, when available, will be subject to the same educational and non-advisory terms described herein. Stock DCA tracking on Da Cycl will be a discipline and scheduling tool only. Da Cycl is not a broker-dealer and will not execute stock trades. Users must use their own brokerage accounts for any stock purchases.

7. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. You must not share your account with others. You must be at least 18 years of age to use the Service. Cycl Factory reserves the right to suspend or terminate accounts that violate these terms.

8. Acceptable Use

You agree not to: - Use the Service for any unlawful purpose - Attempt to reverse engineer or scrape the Service - Interfere with the operation of the Service - Create multiple accounts for abusive purposes - Use the Service in any way that could harm other users Cycl Factory reserves the right to terminate access for any user who violates these terms.

9. Intellectual Property

All content within Da Cycl, including the Da Cycl name, logo, design, code, and written content, is the property of Cycl Factory. You may not reproduce, distribute, or create derivative works without explicit written permission. Third-party news content is provided via RSS feeds and remains the property of respective publishers.

10. Third-Party Services

Da Cycl uses the following third-party services: - Supabase (database and authentication) - CoinGecko (cryptocurrency price data) - Various RSS feeds (news content) - Expo (mobile app infrastructure) - Vercel (web hosting) Use of these services is subject to their respective terms and privacy policies. Cycl Factory is not responsible for the accuracy or availability of third-party data.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CYCL FACTORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYCL FACTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES ARISING FROM USE OF THE SERVICE. YOUR USE OF DA CYCL IS AT YOUR SOLE RISK. INVESTMENT IN CRYPTOCURRENCIES AND STOCKS INVOLVES SUBSTANTIAL RISK OF LOSS. CYCL FACTORY IS NOT RESPONSIBLE FOR ANY FINANCIAL LOSSES INCURRED BY USERS.

12. Changes to Terms

Cycl Factory reserves the right to modify these terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by applicable law. Any disputes arising from these terms or use of the Service shall be resolved through binding arbitration or the courts of competent jurisdiction.
